Representative Matters

  • Represented an estate in two actions by a banking institution wherein the estate owed $12 million in personal guarantees executed by the decedent. The case settled saving the estate approximately $10 million.
  • Represented beneficiary of an over $41 million trust in her action for breach of fiduciary duty, breach of trust, and removal against two derelict trustees who were grossly mismanaging trust property. The matter settled which included the resignation of the trustees.
  • Represented beneficiary and trustee of an approximately $7 million trust in an action brought against him by his sister for his removal and undue influence. The matter settled.
  • Represented beneficiary and trustee in an action against his sister for financial elder abuse and defended him in his sister’s petition for his removal. The matter was settled without his resignation.
  • Represented two beneficiaries in their action against the trustee to invalidate an amendment due to lack of capacity and undue influence, as well as, for intentional interference with expected inheritance and financial elder abuse. The matter settled.
  • Represented the successor trustees in an action by the beneficiary for his removal and return of trust property, wherein it was alleged the trustee engaged in undue influence. The matter settled.
  • Represented beneficiary in her capacity as administrator of her father’s estate and in actions by purported beneficiaries to determine heirship and exclude administrator beneficiary from the estate. The matter settled.
  • Secured return of our client’s home after her daughter and son-in-law moved into the home under the guise of “helping” her, only to defraud her into signing documents signing her home over to them, after which they forced her out of her home. Secured judgment to recover title to the home and monies wrongfully withdrawn against the property.
  • Represented the surviving spouse of her deceased husband’s high eight-figure trust estate, which, through ill-advised estate planning, had left the client as a co-fiduciary with her estranged stepson and a bungling property manager. Prior litigation with previous counsel resulted only in our client’s resignation, which allowed the bunglers to further waste trust assets. Secured a final, global resolution for the surviving spouse that secured the resignations of the “bad” trustees and replaced them with an institutional trustee who is working to remedy their bad acts and save the estate.
