What is a Right of Representation?
A principle that allows descendants of a deceased heir to inherit the share their parent would have received, distributed per stirpes.
A legal principle that allows descendants of a deceased beneficiary to inherit the deceased beneficiary’s share of an estate. This principle ensures that if a beneficiary dies before the decedent, their children or other direct descendants can “represent” them and receive the share of the estate that their parent would have received. This concept helps to maintain equitable distribution among family members in the event of a beneficiary’s death.
