What is a Probate Family Allowance?

A court-ordered allowance paid from the decedent’s estate to support the surviving spouse or minor children during the probate process, typically until the estate is distributed.

A temporary allowance set aside by the probate court to support the decedent’s surviving spouse, children, or other dependents while the estate is being administered. This allowance is meant to provide financial assistance for living expenses during the probate process and is paid out of the estate’s assets before the final distribution to beneficiaries. The amount and eligibility for the allowance vary by state, and it is typically considered a priority claim on the estate.
