What is an Attested Will?

A provision in a will where witnesses affirm that they saw the testator sign the will and that it was executed properly.

A provision found in a will that provides formal confirmation by witnesses that they were present when the will was signed and that the testator (the person making the will) appeared to be of sound mind and not under duress. This clause strengthens the will’s validity, particularly in contested probate cases, as it helps prove the testator’s intent and capacity at the time the will was executed.
