What is a Per Capita Distribution?

A method of distributing an estate where each living beneficiary receives an equal share. In this approach, all descendants at the same generational level receive the same amount, without consideration for how many other descendants there are.

A method of distributing an estate where all surviving beneficiaries receive an equal share, regardless of their relationship to the decedent. If a beneficiary has predeceased the decedent, their share does not pass to their descendants but instead is redistributed among the remaining beneficiaries. This method is often used when there is no clear generational division among heirs, ensuring that all named individuals receive the same amount.
