What is Duress?
Coercion or pressure placed on someone to influence the signing of a will or legal document, which can render it invalid.
A situation in which a person is compelled to act against their will due to threats, coercion, or unlawful pressure. In the context of probate and trust litigation, claims of duress can challenge the validity of a will or trust if it can be shown that the decedent was forced to make or change their estate plan under threat of harm or other undue influence. Successfully proving duress can invalidate the contested documents.
