What Is Ancillary Probate?

A secondary probate process conducted in another state when the deceased owns property outside their home state.

A probate proceeding conducted in a secondary state when the decedent owned property in a state other than their domicile. For example, if a person lived and died in California but owned real estate in Texas, ancillary probate would be necessary in Texas to transfer ownership of that property. This process ensures that all assets in other jurisdictions are properly accounted for and distributed according to law.
