Estate Planning Coordination Risks: Insights from The Street

Scott Rahn, Founding Partner of RMO LLP, was recently cited in The Street in an article on a Bank of America Private Bank report showing how poorly coordinated estate planning can quietly undermine even well-built wealth transfer strategies.

The piece, which included comments Scott made to The Daily Upside, highlights concerns regarding the importance of multigenerational communication when making estate, trust, and gifting decisions. Family members acting independently can duplicate gifts, waste tax exemptions, and inflate an heir’s own taxable estate, even when each decision looks sound in isolation.

Scott’s comments emphasized that many families devote significant effort to building wealth but far less time to communicating their intentions and educating future generations about the purpose of that wealth. A lack of transparency can leave heirs with an incomplete understanding of a family’s goals, values, and estate plan, increasing the likelihood of misunderstandings and disputes after a death.

The takeaway for beneficiaries, trustees, executors, and fiduciaries alike: a well-drafted document isn’t a substitute for a well-informed family. Effective communication, coordinated decision-making, and thoughtful administration can help reduce the risk of future trust and estate litigation while preserving family relationships and the intended legacy of an estate.
